Council use debt collectors "6 million times in 36 months"
Councils called in debt collectors over 6 million times between Aug 2007 and Sept 2010. That breaks down to 4.1 million for council tax and 1.4 million for parking, fines reported The Metro on April 6th. The figures were only released under The Freedom of Information act to Big Brother Watch. The unregulated debt collection business has been reported in many articles on land of the free the relevent articles are listed below.
Around 5,550 cases per day were passed to debt collectors. This explains why council tax and parking fines do not go through any proper court process. The 320 local Authorities who completed the survey, issued 4.5 million council tax liability orders and 1.4 million parking fines. Edinburgh and Glasgow used debt collectors 280,000 times between April 2007 to March 2010.
These debt collectors such as Newlyn, Rundle and Co ltd, JBW plus of course Philips, issue paperwork which is often unlawful and adds amounts to the debt which are also unlawful. Councils like Westminster have done their best to hide these practices on behalf of their partners in revenue collection.
A freedom of information request linked to our site regarding Philips fees reveals that Westminster, like other councils, do not like giving any information about their third party debt collectors. As we have reported in articles on the site the council tax summonses issued by the council and the parking scam operated by the councils with their third party contractors is not dealt with by courts. In the case of traffic fines the stamping process is done at an address implying that it is Northampton County Court , it is not part of the court but the Bulk Clearing Centre which as we reported describes itself as a "registration point for unpaid penalty fares". See article on "NSL and your local council ...." below.After writing to HMCS Court service over an alleged traffic fine they replied "The council has requested this matter go to court, Traffic Enforcement Centre (TEC) at Northampton is a registration point for unpaid penalty fares." This is the usual doublespeak from government departments and quangos which now passes for information.
As we know the word bailiff is now a misused term. A bailiff is not now defined as someone who works a creditor (not a court as the meaning implies). This means of course they have even less power of enforcement than they are leading us to believe. They are merely third party debt collectors who contracted for or bought the debt, therefore they, not the original debtor own the debt.
Philips quote the Domestic Violence and Crimes and Victims Act on their "warrants" which are computer printouts with no provable court authority. This implies they can force entry for civil debt which is of course untrue. Check out "Become a bailiff and earn £5.93 per hour".
