Notice to unlawful Debt Collectors masquerading as bailiffs
One of our contributors put this Notice together in response to an unlawful "Notice of Removal" from a debt collection company whose third party agent (debt collector) was masquerading as a certificated bailiff.
As this is now widespread we have published a template which you can use. If the name on the usually computer generated template (Notice of Removal) is not on the bailiffs register (just look online) then demanding money with threats and menaces is unlawful. Go to Companies House, look up the company and send your notice to the registered office and address your notice to the managing director which can be found on companies house along with all details of the company. Just click the link where it says "order information on this company", you dont have to pay just click the link and all details appear. This is good practice as the directors of these companies need to know they are accountable.

Re: Fraudulent and unlawful Notice from NAME OF "BAILIFF" acting for NAME OF COMPANY
NAME OF COMPANY have delivered mail to the above address which is unlawful for the following reasons:
1 Your Notice states “Final Notice Bailiff Removal”. The name of the person printed on your document NAME OF "BAILIFF is not on the bailiffs register. Your notice is therefore fraudulent.
There is no evidence your third party agent XXXX is not committing fraud and demanding money with threats and menaces. There is no evidence your third party agent is not acting unlawfully and illegally.
2 Your notice is addressed to XXXXXXX there is no person known as XXXXXXX at the above address. Your paperwork has been delivered (NUMBER OF TIMES) and makes threats and menaces to a person unknown at the above address. There is no evidence your third party agent is not guilty of harassment.
3 You state “Goods may be removed in your absence” This is unlawful and untrue. It is also fraud and would be theft if your representative who is not a bailiff removed goods from the above address.
There is no evidence you, your company and your third party agent are not complicit in knowingly committing fraud with threats and menaces.
IF YOUR NOTICE RELATES TO A PARKING TICKET OR TRAFFIC FINE....
4 NAME OF COMPANY, MANAGING DIRECTOR AND "BAILIFF" state that they are acting on a “Warrant of Execution” from Northampton County Court Bulk Centre.
As stated on their own paperwork Traffic Enforcement Centre at Northampton CC is not a court Your statement is therefore untrue. There is no evidence you, your company and your third party representative have not committed fraud.
4 You have demanded unlawful and unsubstantiated amounts of money which have no breakdown or legal standing. There is no evidence your paperwork is not fraudulent and illegal.
5 Your representative XXXXXXX has not signed the documents making them unenforceable as well as fraudulent. There is no evidence your third party representative has not knowingly committed fraud and deception with threats and menaces.
Statement of Intent (optional)
Lawful representatives have been given this evidence and will act immediately if your third party agent who is acting outside the law makes any further visits to the above property. There is no evidence that further illegal paperwork from you, your third party agent and your company will not result in criminal proceedings being brought against you, your company and your third party representative who is masquerading as a certificated bailiff.

Most paperwork we have seen issued by these so called bailiff and debt collection companies is unlawful and unenforceable, unless you consent or contract with them.
